  1. General
    1. Welcome to the Sri Kota Specialist Medical Centre E-store (the “Website”). This Website is owned and operated by Sri Kota Specialist Medical Centre (hereby known as “SKSMC”). Please read the following Terms and Conditions carefully before using this Website. Before becoming a user of the Website, you must read and accept all of the terms and conditions, and you must consent to the processing of your personal data as described in the Privacy Policy linked hereto. Any hyperlink to this Agreement, any other written, electronic, and oral communications with SKSMC and its affiliated entities, or any websites, pages, features, or content owned and operated by us that hyperlink to this Agreement (collectively, including the Site will be referred as “Services”).
    2. Updates to the Terms. We reserve the right to modify the Terms, including the Privacy Policy, at any time, in our sole discretion. By continuing to use the Services, following such changes (regardless of whether a notice was sent by the Company), you agree to be bound by any variation made by us to this policy and/or accompanying policies/agreements including, but not limited to, the Privacy Policy. It is your responsibility to check this policy and/or accompanying policies/agreements from time to time to verify such variations.
    3. Acceptance of Terms. To shop with us, you need to be at least 16 years old. Any accessing, browsing, or otherwise using the Services indicates your agreement to all the terms and conditions in this Agreement. If you disagree with any part of the Terms then you should immediately discontinue access or use of the Services. Please read this Agreement carefully before proceeding.
  2. Use of Our Services
    1. When you use our Services, you agree to the processing of the information and details and you state that all information and details provided are true and correspond to reality. You represent and warrant that you are at least 16 years old or visiting the Services under the supervision of a parent or guardian. Subject to the terms and conditions of this Agreement, SKSMC hereby grants you a limited, revocable, non-transferable and non-exclusive license to access and use the Services by displaying it on your internet browser, for our Website, or on your mobile devices, only for the purpose of shopping for healthcare services sold on the Website and not for any commercial use or use on behalf of any third party, except as explicitly permitted by SKSMC in advance. Any breach of this Agreement shall result in the immediate revocation of the license granted in this paragraph without notice to you.
    2. Limitations on Use. Except as permitted in the paragraph above, you may not reproduce, distribute, display, sell, lease, transmit, create derivative works from, translate, modify, reverse-engineer, disassemble, decompile or otherwise exploit the Services or any portion of them unless expressly permitted by SKSMC in writing. You may not make any commercial use of any of the information provided on the Services or make any use of the Services for the benefit of another business unless explicitly permitted by SKSMC in advance. SKSMC reserves the right to refuse service, terminate accounts, and/or cancel orders in its discretion, including, without limitation, if we believe that customer conduct violates applicable law or is harmful to our interests.You shall not upload to, distribute, or otherwise publish through the Services any content, information, or other material that: (a) violates or infringes the copyrights, patents, trademarks, service marks, trade secrets, or other proprietary rights of any person; (b) is libelous, threatening, defamatory, obscene, indecent, pornographic, or could give rise to any civil or criminal liability under local or international law; or (c) includes any bugs, logic bombs, viruses, worms, trap doors, Trojan horses or other code, material or properties which are malicious or technologically harmful. Additionally, you agree not to:
      ⦿ Use the Services for any unlawful purposes, or in a way that could violate any applicable federal, state, local, or international law or regulation;
      ⦿ To engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Services, or which, as determined by us, may harm us or other persons using the Services or expose us or them to liability;
      ⦿ Use the Services in any manner that could disable, overburden, damage, or impair the Website or Apps or any other party’s use of the Services;
      ⦿ Use any robot, spider or other manual or automated device, process, software or means to index or access the Service for any purpose;
      ⦿ Use the Services to distribute unsolicited promotional or commercial content, or solicit other persons using the Services for commercial purposes;
    3. Information on our Website and changes to it. The information contained in this Website is for general information purposes only. We endeavor to keep the information published on our Website up to date and correct, however we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the Website or the information, products, services, or related graphics contained on the Website for any purpose. Any reliance you place on such information is therefore strictly at your own risk.
    4. You are responsible for configuring your information technology, computer programs and platform in order to access our Website. You should use your own virus protection software, as we do not guarantee that our Website will be secure or free from bugs or viruses at all times.
  3. Privacy Policy
    1. Personal Details. When you use our Services and place orders through them, you agree to provide us with your email address, postal address and/or other contact details truthfully and exactly. You also agree that we may use this information to contact you in the context of your order if necessary.
    2. PDPA. We respect your right to privacy. By using our Services or otherwise you agree to, and where required, consent to the collection, use and transfer of your information as set out in the Personal Data Protection Act Notice.
  4. Trade Rules
    1. Price and Payment. All prices are correct at the time of entering the information on to the system. Prices may change at any time, but changes shall not affect the orders for which we have sent an Order Confirmation.
      Once you have selected all articles that you wish to buy, they will be added to your cart. The next step will be to process the order and make the payment. To that end, you must follow the steps of the purchase process, indicating or verifying the information requested in each step. Furthermore, throughout the purchase process, before payment, you can modify the details of your order.
      To minimize the risk of non-authorized access, your credit card details will be encrypted. Once we receive your order, we request a pre-authorization on your card to ensure that there are sufficient funds to complete the transaction.
      When you click “Authorize Payment” or alike, you are confirming that the credit card is yours. Credit cards are subject to verification and authorization by the card issuing entity.
    2. Guest Checkout. The Website has guest checkout feature which allows you to make purchase without creating an account. Please ensure billing details are as accurate as possible. You are unable to alter those details thereafter. SKSMC will not be held responsible for inaccurate billing information input by you.
    3. Services in detail. All services will be conducted in Sri Kota Specialist Medical Centre, Klang, Selangor Darul Ehsan, Malaysia. You will need to print the order confirmation email in order to claim the service that you have ordered from this Website. You are encouraged to make appointment via +03 3375 7733 and visit SKSMC with the printed order as soon as possible. All orders have a 3 months expiry from the date of purchase.

  5. Refund Policy
    1. Application for Return/Refunds. Subject to the terms and conditions in this Refunds and Return Policy, Buyer may apply for return of the purchased items (“Item”) and/or refund within 7 days from the date of purchase by emailing to accounts@srikotamedical.com .
    2. Refund/Return Approval. The approval of your request for refund and return will be made by Sri Kota Specialist Medical Centre in its sole discretion. Buyer acknowledges and agrees that Sri Kota Specialist Medical Centre’s decision is final, conclusive and binding, and covenants and agrees that it will not bring suit or otherwise assert any claim against Sri Kota Specialist Medical Centre or its affiliates in relation to such decision.
  6. Intellectual Property Rights and Ownership
    1. SKSMC is the owner or the licensee of all intellectual property rights in our Website, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
    2. You must not use any part of the content on our Website for commercial purposes without obtaining a licence to do so from us or our licensors.
    3. If you print off, copy or download any part of our Website in breach of these terms of use, your right to use our Website will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
  7. Limitation of our liability 
    1. To the extent permitted by Malaysian law, we exclude all conditions, warranties, representations or other terms which may apply to our Website or any content on it, whether express or implied.
    2. We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

      ⦿ use of or reliance on any content displayed on our Website.
    3. Business user. If you are a business user, please note that in particular, we will not be liable for: loss of profits, sales, business, or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; or any indirect or consequential loss or damage.
    4. Consumer user. If you are a consumer user, please note that we only provide our Website for domestic and private use. You agree not to use our Website for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Website or to your downloading of any content on it, or on any Website linked to it.
    6. Websites linked to our Website. We assume no responsibility for the content of Websites linked to our Website. Such links should not be interpreted as endorsements by us of those linked Websites. We will not be liable for any loss or damage that may arise from your use of them.
